In May of the same year, police officers demanded that the activist sign the summons retroactively, but he refused to do so. In August, he was interrogated as part of the pre-investigative investigation into the criminal case of evasion of military service, and after that he was served three summonses to the military enlistment office at once. During a visit there in September, according to Shvarts himself, he was attacked by the head of the military enlistment office. The young man also said that during one of the visits to the military enlistment centre, they removed mention of all illnesses from his personal file. On 30 December 2020, the last day of the draft, Shvarts was summoned for questioning by the IC. He said that after the interrogation the investigator took away his phone, two employees of the Centre "E" took him to a private clinic and paid for the examination themselves. The doctors confirmed that Shvarts was unfit for service due to a medical condition, and he was released.

In February 2021, the Investigative Committee terminated the activist's criminal case, but in August the prosecutor's office cancelled this decision: representatives of the agency did not find "legal grounds for exemption from service.

In March 2021, a case was brought against him for violation of the secrecy of correspondence and telephone conversations because of the publication of a video about falsifications in the vote on amendments to the Constitution: Shvarts called three high-ranking officials on behalf of the president's representative. He was charged on his own recognisance. Initially, the officials had no claims against him, but the case was sent for revision, they were re-interviewed, after which they filed lawsuits against Shvarts totalling 1.75 million rubles. In August 2021, Shvarts was put on a wanted list because he twice failed to appear at court hearings. The activist left Russia and was granted political asylum in Germany in early 2022.

In 2023, it became known that a case was also brought against Shvarts for spreading deliberately false information about the Armed Forces, the details are unknown. According to Shvarts, this is the sixth criminal case against him. On 18 October, he was sentenced in absentia to six years in prison.
