A criminal case for allegedly distributing a leaflet calling for extremist actions was opened on 18 November 2009. On 14 April 2010, Kutuzov's flat was searched, after which he was sent to a temporary detention centre for 48 hours as a suspect and then released on his own recognizance. On 16 April 2010, the FSB investigator took Kutuzov's signature on non-disclosure of the preliminary investigation data (this order was declared illegal by the decision of the Central District Court of Tyumen on 24 May 2010). On 1 November 2010, the criminal case with the indictment was sent to the prosecutor's office. On 14 March 2011, Kutuzov was sentenced to two years' suspended imprisonment with a probation period of three years. On 7 September 2011, after the verdict was handed down, he was dismissed from his place of work, presumably due to his criminal record. In July 2012, it became known that Kutuzov's Zapsibkombank card was blocked due to his inclusion in the Rosfinmonitoring's List of Terrorists and Extremists.

Previously, Kutuzov was subjected to pressure from the Centre "E" and FSB officers in connection with his public activities.
