On 21 January 2011 the Chelyabinsk Investigation Department of the Investigative Committee of the Investigative Committee of the Russian Federation for the Chelyabinsk region initiated a criminal case against Andrei Yermolenko under part 1 of article 282 of the Criminal Code of the Russian Federation based on the materials of the main department of the Ministry of Internal Affairs in the Urals Federal District with the participation of the Main Department of Internal Affairs of the Chelyabinsk region. After that, on 2 February 2011, a search was conducted in his flat, during which a personal computer and a laptop were seized, which, in the opinion of the searchers, could contain an article inciting hatred towards the social group "civil servants", all books by Yuri Mukhin, as well as other items, documents and valuables. According to the data reported by the person under investigation, a preliminary linguistic study was conducted in the Urals Regional Bureau of Forensic Expertise and it was concluded that the article contained statements aimed at humiliating the dignity of a group of people on the grounds of belonging to certain social groups. At the same time, the police officers did not inform Ermolenko of the date of the research and did not provide the materials of this expertise. The last investigative action as of 14 October 2011 was the appointment of an additional expert examination on 16.06.2011. On 28 December 2011, R.R. Gilmanshin, senior investigator of the Investigative Committee of the Chelyabinsk City Investigation Department, signed a resolution to dismiss the criminal case due to the absence of corpus delicti in Andrei Yermolenko's actions.

The resolution to initiate a petition for permission to search was signed and subsequently searched by the investigator for internal affairs of the Chelyabinsk Investigation Department of the Investigative Committee of the Investigative Committee of the Russian Federation for the Chelyabinsk Region, Captain of Justice A.A. Kolov; also involved in the search was the senior operative of the Department of Internal Affairs for the Urals Federal District, V.V. Kataev, The ruling authorising the search was signed by the judge of the Tractorozavodskiy District Court of Chelyabinsk, E.S. Ageyev. On 28 December the case was dismissed.
