In December 2017, Ushachev was placed under house arrest. The charge of incitement to hatred was dropped, the charge of insulting the feelings of believers was reclassified from Part 2 to Part 1 (the reference to committing acts in places specially designed for holding religious services was excluded). On 8 February 2018, he was sentenced to 320 hours of compulsory labour. In connection with the deprivation of freedom, after the decision has taken effect, Ushachev should be released from serving the sentence.
