The first case of discrediting the use of the Armed Forces of the Russian Federation was allegedly initiated in November 2022. In addition, a case of illegal possession of explosives was initiated. Borisenko was given a recognisance not to leave.
In May 2023, Borisenko was arrested for 15 days because he had not paid a fine on time for illegally crossing the road. On 6 June, after leaving the detention centre, Borisenko was detained again and taken to the police station. The next day, the court sent him into custody on a new case of discrediting the army. This case was initiated because of three video appeals in which he condemned the war in Ukraine.
On 15 June, Borisenko was transferred to house arrest. On 5 October, the court refused to extend the house arrest.
On 1 December 2023, Borisenko was sentenced in the first case to six years suspended and a fine of 150 thousand rubles. In the second case, the verdict was handed down on 13 August 2025: Borisenko was sentenced to one year suspended.
