On 30 September in autumn 2016, Sushchenko came to Moscow to visit relatives and was detained the same day after someone handed him a hard drive. He was charged with espionage. According to the FSB version, Sushchenko is an employee of the Main Intelligence Directorate of the Ukrainian Defence Ministry and collected secret information about the work of the Russian military and Rosgvardia. The Ukrainian State Intelligence Service denied this information, while the Ukrainian Foreign Ministry called the case falsified. Sushchenko himself denies the accusations.

The administration of the pre-trial detention centre refused to hand over most of Sushchenko's letters to the outside world. According to her, the meeting with his wife took place only after Putin's talks with Poroshenko.
The trial in Sushchenko's case was held behind closed doors. On 4 June 2018, Sushchenko was sentenced to 12 years in a strict regime colony.
On 7 September 2019, Sushchenko was pardoned and released as part of the exchange of Ukrainian political prisoners for a group of people released by Ukraine arrived in Ukraine.
