On 18 November 2019, Fomin was detained after a search. On 21 November, the court placed him in custody on charges of participation in the activities of a terrorist organisation due to his alleged involvement in the Islamist party Hizb ut-Tahrir, which has no connection to terrorism. On 4 August 2022, Fomin was sentenced to 12 years in a strict-regime penal colony.
Later it became known that a case of public justification of terrorism was brought against the Tyumen's resident because of his conversations with cellmates in the Tyumen pre-trial detention centre. According to him, it was "criticism", including "towards current events". On 7 April 2025, Fomin was sentenced to three years in prison, combined with the previous sentence, the total term was 13 years in a strict regime penal colony.
