On 1 April 2012, he was detained by the police during an attempted mass walk with white ribbons on the Red Square and taken to the Tverskoy police station; three hours after his arrival, when the time during which he and other detainees could be held in the department had expired, they attempted to leave; a police officer prevented them from leaving the assembly hall where they were held and punched Pozdnyakov in the face; Pozdnyakov announced his intention to record the beatings and bring the police officer to justice, afterward he filed a complaint with the prosecutor's office; following this, police officers announced a preliminary investigation into the fact of violence against the police officer by Pozdnyakov himself; in May 2012, a case was reported to have been opened against Pozdnyakov under Art. 318 of the Criminal Code; on 31 May 2012, Pozdnyakov was detained on the instructions of an operative of the Centre "E" on Triumfalnaya Square during the "Strategy-31" rally; he was taken to the Tverskoy police station where he was charged; on 6 June, he was interrogated again, and the investigation chose his personal recognizance as a measure of restriction; on 14 March 2013, he was sentenced to two years of suspended imprisonment with a probation period of three years.
